Dougherty Associates, LLC, doing business as Everglades Boats (“Everglades Boats,” “Everglades,” “Company,” “we,” “us,” or “our”), operates the website located at www.evergladesboats.com, the Everglades Boat Builder platform located at boatbuilder.evergladesboats.com, resources.evergladesboats.com, and any other websites, applications, digital platforms, configurators, online services, and related technologies owned or operated by Everglades Boats (collectively, the “Sites”).

These Terms of Use govern your access to and use of the Sites and any content, functionality, products, services, tools, or features made available through them.

 

2. Related Policies

Your use of the Site is also governed by:

  • Privacy Policy;
  • Cookie Policy;
  • Cookie Preferences Center; and
  • Any additional terms applicable to specific products, programs, promotions, or services.

The Site utilizes analytics, advertising, personalization, customer relationship management, and other digital technologies as described in the Privacy Policy and Cookie Policy. The activation and operation of certain technologies may depend upon the visitor’s consent preferences, geographic location, browser settings, and applicable legal requirements.

If a conflict exists between these Terms and any program-specific terms, the program-specific terms will govern.

The Site is provided for informational purposes only. While Everglades Boats strives to maintain accurate and current information, we do not warrant that information appearing on the Site is complete, current, accurate, or error-free.

Boat specifications, dimensions, capacities, fuel capacities, weights, draft measurements, horsepower ratings, performance data, range estimates, photographs, renderings, videos, color representations, standard features, optional equipment, pricing, availability, and model-year specifications are subject to change without notice. Actual vessels may differ from those depicted on the Site. Nothing contained on the Site constitutes a binding offer to sell any vessel, product, service, financing arrangement, or employment opportunity.

 

4. Dealer Relationships

Everglades Boats distributes products through independently owned and operated authorized dealers. Authorized dealers are not agents, employees, joint venturers, or legal representatives of Everglades Boats.

Everglades Boats is not responsible for:

  • Dealer pricing;
  • Dealer inventory;
  • Dealer financing arrangements;
  • Dealer-installed equipment;
  • Dealer representations;
  • Dealer service practices;
  • Dealer warranties beyond those expressly provided by Everglades Boats; and/or
  • Agreements entered into between customers and independent dealers.

Any transaction with an authorized dealer is solely between the customer and the dealer.

 

5. Acceptable Use

You agree not to:

  • Violate applicable laws;
  • Interfere with Site functionality;
  • Attempt unauthorized access;
  • Introduce malicious code;
  • Scrape, harvest, copy, or extract Site content using automated tools;
  • Use artificial intelligence systems, bots, crawlers, or data-mining tools without written authorization;
  • Misrepresent your identity; and/or
  • Use the Site for unlawful, harmful, fraudulent, or competitive purposes.

Everglades Boats reserves the right to suspend or terminate access to the Site at any time.

 

6. User Accounts

Certain portions of the Site may require account registration. You are responsible for:

  • Maintaining account confidentiality;
  • Protecting login credentials;
  • Ensuring information remains accurate; and
  • All activity occurring under your account.

Everglades Boats may suspend or terminate accounts at its sole discretion.

Any comments, reviews, testimonials, photographs, videos, suggestions, feedback, or other content submitted to Everglades Boats may be used by Everglades Boats without compensation.

By submitting content, you grant Everglades Boats a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, publish, modify, distribute, display, and create derivative works from such content for business, marketing, promotional, advertising, educational, and commercial purposes. You represent that you own or control all rights necessary to grant these permissions.

 

8. Financing Information

Financing information presented on the Site is provided for informational purposes only and may be offered through independent third-party providers. Everglades Boats does not guarantee financing availability, approval, rates, terms, or conditions.

 

9. Intellectual Property

All Site content, including text, graphics, photographs, videos, product descriptions, trademarks, logos, designs, software, and other materials, are owned by Everglades Boats or its licensors and are protected by applicable intellectual property laws.

No portion of the Site may be copied, reproduced, distributed, modified, displayed, published, or otherwise exploited without prior written permission.

 

10. Copyright Complaints

11. Warranty Disclaimer

Nothing contained on this Site shall modify, expand, or replace any written limited warranty provided with an Everglades vessel. Warranty coverage is governed exclusively by the applicable written warranty documentation accompanying the vessel. Marketing materials, website content, photographs, videos, and promotional statements do not create warranties of any kind.

 

12. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EVERGLADES BOATS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY. USE OF THE SITE IS AT YOUR SOLE RISK.

 

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERGLADES BOATS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, DEALERS, AGENTS, SUPPLIERS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SITE. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO DISCONTINUE USE OF THE SITE.

 

14. Indemnification

You agree to defend, indemnify, and hold harmless Everglades Boats and its affiliates from any claims, damages, liabilities, losses, costs, and expenses arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party rights.

 

15. Dispute Resolution and Arbitration

Any dispute arising from or relating to the Site shall be resolved through binding individual arbitration administered by the American Arbitration Association. Class actions, class arbitrations, representative actions, and jury trials are waived to the fullest extent permitted by law. Florida law shall govern these Terms.

 

16. Force Majeure

Everglades Boats shall not be liable for delays, interruptions, or failures resulting from causes beyond its reasonable control, including natural disasters, supply chain disruptions, labor disputes, governmental actions, cyberattacks, utility failures, or acts of God.

 

17. Changes to These Terms

Everglades Boats reserves the right to update these Terms at any time. Updated Terms become effective upon posting. Continued use of the Site constitutes acceptance of revised Terms.
